DJOUBO Terms of Use

Preamble

These terms of use are concluded between:

- DJOUBO, hereinafter referred to as "the Publisher",

And

- Any person wishing to access the mobile application, hereinafter referred to as "the User".

Article 1 - Principles

The purpose of these terms of use is to legally govern the use of the mobile application and its services by the User.

The mobile application is a service of:

The User must accept these Terms of Use before downloading or using the Mobile Application by checking the box "I acknowledge that I have read and accept the Terms of Use" at the place provided for this purpose.

These Terms of Use are accessible at any time in the Mobile Application in the "T.O.U" section found in the MAIN MENU and will prevail, if necessary, over any other version or any contradictory document.

Article 2 - Changes and duration of the Terms of Use

These terms of use are concluded for an indefinite period. The contract takes effect for the User from the start of use of the service.

The Publisher reserves the right to modify the clauses of these terms of use at any time and without justification. Users will be informed of changes to these terms by the publication of the updated Terms of Use on the application and by a notification indicating this change.

Article 3 - Access to the mobile application

The Service is a mobile application that connects VTC and TAXI drivers with Users for medium and long-distance trips.

The DJOUBO Mobile Application can be downloaded via mobile app stores (Google Play and App Store) using available technologies, including a smartphone.

To benefit from the Service, the User must be of legal age and have a smartphone, internet access, and a personal User account.

The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not the responsibility of the Publisher.

To access the service, any User must first register by creating a personal user account and validating the Terms of Use. To create a personal User account, the User must register by filling out the registration form at the start of the Mobile Application and provide the following information: first name, last name, address, email, chosen password, phone number.

Validation of the personal user account is formalized by sending an email to the address provided by the User in the registration form.

The Mobile Application reserves the right to verify the user's phone number by sending a code or by a phone call.

In case of forgotten password, simply click on "forgot password" and the application will send a link to the User's email address to reset it.

Providing this data and validating the personal account are essential for the provision of the Service.

The User undertakes to provide true, complete, and always up-to-date information.

If the information provided by the User proves to be false, incomplete, outdated, or does not allow the Service to be provided under the best conditions, DJOUBO reserves the right to close the User's personal account and thus refuse access to the Service, without notice and without any right to compensation. The User undertakes to create only one personal account corresponding to their own identity.

The User remains solely responsible for any use that may be made of their identifiers and password, and for their confidentiality, as well as for any use of their personal account.

The User undertakes to immediately inform DJOUBO of any use or risk of fraudulent use of their personal account, and of any breach of the confidentiality and security of their identifiers and password at the following email address: team@djoubo.app

The User of the application has access to the following services: booking trips carried out by TAXI or VTC drivers, searching for trips, creating a personal account, paying for ordered services, after-sales service.

The various services may be interrupted or suspended by the Publisher, particularly during maintenance, with prior notice and justification.

Article 4 - Responsibilities

The Publisher cannot be held liable in the event of failure, breakdown, difficulty, or interruption of operation, preventing access to the mobile application or any of its functionalities.

The connection equipment used to access the application is the sole responsibility of the User, who must take all appropriate measures to protect the equipment and data, particularly from viral attacks via the Internet.

The Publisher cannot be held liable in the event of legal proceedings against the User:

The Publisher is not responsible for any damages caused to the User, third parties, and/or the User's equipment as a result of their connection to or use of the mobile application, and the User waives any claims against the Publisher in this regard.

If the Publisher is subject to amicable or legal proceedings due to the use of the application by the User, it may turn against them to obtain compensation for all damages, sums, convictions, and costs that may result from such proceedings.

Article 5 - Intellectual property

All technical documents, products, photographs, texts, logos, drawings, videos, etc., are subject to copyright and are protected by the Intellectual Property Code. When provided to our clients, they remain the exclusive property of DJOUBO, the sole holder of intellectual property rights to these documents, which must be returned to it upon request.

Our clients undertake not to use these documents in any way that may infringe the supplier's industrial or intellectual property rights and undertake not to disclose them to any third party, except with the express and prior authorization of the Publisher.

Article 6 - Hyperlinks

The creation by the User of any hyperlinks to all or part of the mobile application is strictly prohibited, except with the prior written authorization of the Publisher, requested by email at the following address: team@djoubo.app.

The Publisher is free to refuse this authorization without having to justify its decision in any way. If the Publisher grants its authorization, it is in any case only temporary and may be withdrawn at any time, without any obligation to justify it on the part of the Publisher.

In any case, any link must be removed upon simple request from the Publisher.

Article 7 - Protection of personal data

The personal data collected from users is intended to provide the services of the mobile application, improve them, and maintain a secure environment. Specifically, the uses are as follows:

Security and confidentiality

The mobile application implements organizational, technical, software, and physical measures in terms of digital security to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment and the application cannot guarantee the security of the transmission or storage of information on the Internet.

Implementation of users' rights

Changes to this clause

The mobile application reserves the right to make any changes to this clause relating to the protection of personal data at any time. If a change is made to this personal data protection clause, the mobile application undertakes to publish the new version on the application itself.

The mobile application will also inform users of the change by email, at least 15 days before the effective date. If the user does not agree with the terms of the new version of the personal data protection clause, they have the option to delete their account.

Article 8 - Applicable law

These terms of use are subject to French law.

If the parties are unable to resolve a dispute amicably, the dispute will be submitted to the jurisdiction of the French courts.
